Continuity of TSG Analysis on eSick Leave

TSG has continuously analysed the implementation of the eSick Leave system in Serbia, including digitalization of sick leave processes, employer obligations, and regulatory developments effective April 1, 2026:

The introduction of the eSick Leave system establishes mandatory electronic data exchange regarding temporary incapacity for work, fully replacing previous paper-based documentation. Employers are enabled to monitor employee sick leave status centrally, with real-time data updates.

As of April 1, 2026, the system’s functionality has been further enhanced, allowing employers to electronically submit compensation claims, receive salary reimbursement calculations, and initiate procedures related to objections and reassessments of sick leave.

Access to the system is provided via the eUprava portal, where user registration and account management are conducted.

Data Protection and Employer Liability

The article places particular emphasis on personal data processing, considering that health-related data constitute a special category of sensitive data. Employers are granted access exclusively to basic information on incapacity for work and its duration, while diagnosis and medical documentation remain inaccessible.

In accordance with data protection regulations, employers are required to restrict access, establish clear internal procedures, and implement appropriate technical and organizational safeguards.

Digitalization and Next Steps

The digitalization of sick leave procedures forms part of a broader healthcare system transformation aimed at increasing efficiency and transparency. At the same time, it imposes additional compliance obligations on employers regarding lawful data processing and protection.
