Can a public enforcement officer continue with the execution of an enforcement decision?

Under the new Law on Enforcement and Security, applicable as of 1 July 2016, enforcement creditors in ongoing enforcement procedures, where the enforcement decision was rendered before enforcement officers started working in Serbia (i.e. before 17 May 2012), are required to state before the court whether they choose further enforcement procedure to be performed by the court or by public enforcement officers.

Enforcement creditors are required to submit this statement in writing to the court between 1 May 2016 and 1 July 2016.

If enforcement creditors fail to submit this statement on time, the enforcement proceeding will be terminated.
